Know the terms of an electronic connection for marketing purposes under the "Personal Data"

A government bill protecting personal data before the Communications and Information Technology Committee of the House of Representatives, headed by MP Ahmad Badawi, prohibits any electronic communication for the direct marketing of a person in relation to personal data unless a number of specific conditions are met.


Article (17), which the Communications Committee concluded from its discussion, specified the conditions that must be met for conducting electronic communication for the purpose of electronic marketing, as follows:



1. Obtaining the prior consent of the person concerned with the data, or if the electronic communication is consistent with the purpose and activity of the marketing controller of its products and services, without prejudice to the interests and rights of the person concerned with the data.


2- The contact must include a founding and sending identity.


3- The sender must have a correct enough address to access it.


4. The indication that the electronic communication is sent for direct marketing purposes.


6. Establish clear and accessible mechanisms to enable the person concerned to reject the electronic communication or to opt out of its consent.
